Enforcement of Orders

In Texas family law cases, enforcement actions are legal proceedings used to compel compliance with court orders, typically related to child support, custody (possession and access), spousal support, and property division. These actions are filed when one party fails to follow a court order. Our attorneys will help you assess whether you could benefit from pursuing an enforcement case.

Child Support Enforcement –

  • The Texas Attorney General’s Office (OAG) or a private attorney can file an enforcement motion.
  • Common remedies include wage garnishment, tax refund interception, license suspension, and even jail time for contempt.

Child Custody & Visitation (Possession and Access) Enforcement –

  • A parent who is denied court-ordered visitation can file an enforcement motion.
  • Remedies may include make-up visitation time, fines, contempt charges, or modification of custody arrangements.

Spousal Support (Alimony) Enforcement –

  • If a spouse fails to pay court-ordered spousal maintenance, the receiving party can seek enforcement.
  • Courts may issue wage withholding orders or hold the non-paying party in contempt.

Property Division Enforcement –

  • If an ex-spouse fails to comply with the division of assets as ordered in the divorce decree, the other party can file an enforcement motion.
  • The court may order compliance, fines, or even seizure of assets.
